In Ukraine, the law No. 3528-IX on medical cannabis came into force. The law regulates the circulation of cannabis for medical and industrial purposes, as well as for scientific and technical activities. Farmers who want to grow medical cannabis must meet certain conditions.
According to the State Service of Medicines and Drug Control of Ukraine, a license is required for the cultivation, purchase, transportation, import/export, production, storage, use and sale/destruction of medical cannabis.
In order to cultivate cannabis plants for medical purposes, certain conditions must be met, in particular:
- cultivation should only take place in enclosed soil conditions (e.g. greenhouses) with 24-hour video surveillance and free 24-hour access to the National Police.
- before starting cultivation to submit to the State Service the package of documents specified in Article 8 of the Law in order to obtain a license. This includes, in particular, the permission from the National Police to use facilities and premises intended for the trafficking of narcotic drugs, psychotropic substances and precursors. The State Service of Ukraine for Medicines and Drug Control reviews the documents and makes a decision on granting the appropriate license.
- purchase conditioned and certified seeds. The procedure for its acquisition will be established by the Cabinet of Ministers. Such seed must have a quality certificate and be registered in the register for the seed (commodity) quality of the seed.
- cultivate cannabis plants in accordance with the requirements of Article 15 of the Law.
- carry out laboratory tests to determine the tetrahydrocannabinol (THC) content of dried cannabis straw. The selection of samples is carried out with the participation of the National Police in accordance with the procedure established by the Cabinet of Ministers. No harvesting is allowed until the results of the laboratory tests are available.
- obtain a license for the production of narcotic drugs, psychotropic substances and precursors registered as medicinal products.
- the cannabis plant substance (active pharmaceutical ingredient – API) will be produced from the harvested crop of hemp plants.
- to register the plant substance of cannabis (API) in the State Register of Medicinal Products. For registration, a set of documents must be submitted that can be used to make a reasoned conclusion about its effectiveness, safety and quality.
